By accessing or using this website, submitting a project inquiry, requesting an estimate, requesting a consultation, or engaging our services, you acknowledge that you have read and agree to these Terms.
1. Purpose of HomeBuildersNJ.net
HomeBuildersNJ.net provides information, lead-generation, project coordination, construction-related services, and other resources relating to residential and custom home construction in New Jersey.
The website may assist property owners who are interested in building a new home on their own property or on property they intend to acquire.
Information displayed on this website is provided for general informational and preliminary planning purposes and does not, by itself, constitute a construction contract, guaranteed price, architectural agreement, engineering agreement, financing commitment, or promise to construct a particular home.
2. Home Construction Services
Depending on the nature and location of a project, HomeBuildersNJ, its owners, operators, affiliated firms, or participating construction companies may:
- Build and manage the project directly;
- Enter into a construction agreement directly with the client;
- Perform some or all construction-related services through an affiliated company;
- Work with an affiliated general contractor;
- Work with an independent general contractor in our professional network;
- Engage subcontractors and specialty contractors;
- Coordinate architects, engineers, designers, consultants, suppliers, and other professionals; or
- Refer or introduce the client to an appropriate construction company or professional.
The entity or entities actually responsible for construction will be identified in the applicable written proposal, construction contract, or other project documentation.
3. Affiliate and Network General Contractors
HomeBuildersNJ may maintain relationships with affiliated, associated, or independent general contractors and other construction professionals.
A contractor introduced or recommended through HomeBuildersNJ may be:
- An affiliated company;
- A separately owned company;
- An independent general contractor;
- A contractor within our professional network; or
- Another qualified construction professional.
Unless expressly stated in a written agreement, an independent contractor is not an employee, agent, or legal representative of HomeBuildersNJ.
The applicable construction agreement should identify the contracting parties and establish responsibility for construction work, supervision, employees, subcontractors, insurance, permits, warranties, payments, and other project obligations.
4. No Construction Contract Through Website Inquiry
Submitting a contact form, requesting an estimate, sending an email, calling HomeBuildersNJ, or communicating through the website does not create a construction contract.
No construction project is considered accepted or authorized until the applicable parties have entered into a written agreement.
A written construction agreement may include:
- Property address;
- Construction scope;
- Plans and specifications;
- Contract price or pricing methodology;
- Materials and allowances;
- Payment schedule;
- Change-order procedures;
- Construction schedule;
- Permit responsibilities;
- Client responsibilities;

5. Construction Estimates and Pricing
HomeBuildersNJ may provide preliminary construction estimates, cost-per-square-foot information, budgets, pricing ranges, calculators, or other cost information.
Unless expressly stated otherwise in a signed written agreement, such information is an estimate only and is not a guaranteed construction price.
Actual costs may vary because of:
- Home size;
- Architectural design;
- Building materials;
- Finish selections;
- Site conditions;
- Soil conditions;
- Foundation requirements;
- Excavation;
- Grading;
- Drainage;
- Utility connections;
- Municipal requirements;
- Building permits;
- Professional fees;
- Labor costs;
- Material costs;
- Market conditions;
- Financing requirements;
- Client-requested changes; and
- Unforeseen conditions.
6. Construction on Client-Owned Land
HomeBuildersNJ may assist clients who own land or intend to purchase land for construction.
Clients are responsible for providing accurate information regarding the property and for satisfying applicable ownership, financing, zoning, title, environmental, and other requirements unless a written agreement specifically assigns a particular responsibility to HomeBuildersNJ or another project participant.
HomeBuildersNJ does not guarantee that a particular property will be suitable for construction.
7. Construction Financing
Clients may use cash, construction loans, mortgages, private financing, or other funding sources to finance a project.
HomeBuildersNJ does not guarantee financing approval or loan terms.
Any financing information presented on HomeBuildersNJ.net is general information and should not be considered financial, lending, tax, or legal advice.
The client remains responsible for obtaining adequate financing and satisfying all lender requirements unless otherwise agreed in writing.
8. Architectural, Engineering, and Other Professional Services
A residential construction project may require architectural, structural engineering, civil engineering, mechanical, electrical, plumbing, surveying, geotechnical, environmental, energy, or other professional services.
Such services may be provided by appropriately qualified and licensed professionals.
Unless expressly included in a written agreement, website pricing or preliminary construction estimates should not be interpreted as including all architectural, engineering, permitting, surveying, testing, or professional fees.
9. Permits and Government Approvals
Projects may require building permits, zoning approvals, variances, inspections, utility approvals, environmental approvals, or other governmental authorizations.
Responsibility for obtaining particular approvals will be established in the applicable project agreement.
HomeBuildersNJ does not guarantee approval by any municipality, governmental agency, utility company, zoning board, building department, or other authority.
10. Site Conditions and Unforeseen Conditions
Construction estimates may be prepared using information available at the time of estimation.
Actual site conditions may differ from available information.
Examples of potentially unforeseen conditions include:
- Unsuitable soil;
- Rock;
- Groundwater;
- Drainage problems;
- Buried structures;
- Existing foundations;
- Existing utility conditions;
- Environmental conditions;
- Structural conditions; and
- Other concealed or unknown conditions.
The treatment and financial responsibility for unforeseen conditions will be determined by the applicable written agreement.
11. Client Responsibilities
Clients may be responsible for:
- Providing accurate property information;
- Providing timely project decisions;
- Reviewing plans and specifications;
- Selecting materials and finishes;
- Making required payments;
- Obtaining financing;
- Providing property access;
- Disclosing known property conditions;
- Cooperating with contractors and professionals;
- Responding to requests for information; and
- Performing other obligations specified in the project agreement.
Client delays or failure to perform contractual responsibilities may affect project cost and schedule.
12. Change Orders
Changes to plans, materials, specifications, finishes, dimensions, scope of work, or other project requirements may result in additional costs or schedule changes.
Where required by the applicable construction agreement, changes must be documented through a written change order or other written authorization.
HomeBuildersNJ and/or the applicable contractor may require written approval before performing additional or changed work.
13. Construction Schedule
Any construction schedule or estimated completion date provided through HomeBuildersNJ.net is preliminary unless expressly guaranteed in a signed written agreement.
Schedules may be affected by:
- Weather;
- Permitting;
- Inspections;
- Material availability;
- Labor availability;
- Supply-chain issues;
- Design changes;
- Client decisions;
- Site conditions;
- Governmental requirements;
- Contractor availability; and
- Other circumstances beyond reasonable control.
14. Subcontractors and Suppliers
Construction projects may involve subcontractors, specialty contractors, suppliers, manufacturers, consultants, and other third parties.
The applicable general contractor or construction company may select qualified subcontractors and suppliers consistent with the applicable project agreement.
15. Website Photographs and Project Examples
Photographs, floor plans, renderings, illustrations, completed homes, architectural styles, materials, and project examples shown on HomeBuildersNJ.net may be provided for illustrative purposes.
Actual homes may differ in appearance, dimensions, materials, features, specifications, pricing, and availability.
No photograph or example on the website constitutes a guarantee that an identical home or feature will be available for a particular client.
16. No Guarantee of Project Approval or Completion
Use of HomeBuildersNJ.net does not guarantee:
- Financing approval;
- Zoning approval;
- Building permits;
- Architectural approval;
- Engineering approval;
- Contractor availability;
- Material availability;
- A particular construction cost;
- A particular construction schedule;
- Project completion;
- A particular resale value; or

17. Third-Party Contractors and Professionals
HomeBuildersNJ may introduce clients to third-party contractors, architects, engineers, suppliers, lenders, consultants, and other professionals.
Unless specifically stated in a written agreement, third-party providers are independent entities.
Clients should review the qualifications, licensing, insurance, contracts, warranties, pricing, and responsibilities of third-party providers before engaging them.
18. No Professional Advice
Information provided through HomeBuildersNJ.net is not a substitute for individualized legal, financial, tax, insurance, architectural, engineering, construction, or other professional advice.
Clients should obtain appropriate professional advice concerning their particular property and project.
19. Intellectual Property
Unless otherwise stated, the content of HomeBuildersNJ.net—including its name, logos, text, graphics, designs, website layout, trademarks, service marks, and other materials—is owned by or licensed to HomeBuildersNJ.
You may not reproduce, copy, modify, distribute, publish, sell, or commercially exploit website content without prior written authorization.

Any rights, obligations, warranties, limitations, and liabilities relating to an actual construction project will be governed primarily by the applicable written construction agreement.
23. Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless HomeBuildersNJ, its owners, operators, affiliates, officers, employees, agents, contractors, consultants, and service providers from claims, damages, liabilities, costs, and expenses arising from:
- Your unlawful use of the website;
- Your violation of these Terms;
- Your intentional or negligent misconduct; or
- Your material breach of an applicable agreement.
This provision does not apply to the extent prohibited by applicable law.
24. Force Majeure
HomeBuildersNJ and/or the applicable contractor will not be responsible for delays or inability to perform caused by circumstances beyond reasonable control, to the extent permitted by the applicable construction agreement and law.
Such circumstances may include severe weather, natural disasters, governmental actions, labor disruptions, supply-chain disruptions, material shortages, utility failures, transportation disruptions, epidemics, acts of war, or other extraordinary events.
25. Dispute Resolution
Disputes concerning an actual construction project will be governed by the dispute-resolution provisions contained in the applicable written construction agreement.
Disputes relating solely to the HomeBuildersNJ.net website or these Terms will be governed by applicable New Jersey law, unless otherwise required by law or agreed in writing.
26. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
27. No Waiver
Failure by HomeBuildersNJ to enforce any provision of these Terms does not constitute a waiver of its right to enforce that provision or any other provision in the future.
28. Changes to These Terms
HomeBuildersNJ may modify these Terms from time to time to reflect changes in its business, services, technology, or applicable legal requirements.
Updated Terms will be posted on HomeBuildersNJ.net with a revised “Last Updated” date.
29. Relationship to Project Contracts
These website Terms & Conditions do not replace or supersede a signed construction agreement, architectural agreement, engineering agreement, subcontract, proposal, change order, or other project-specific agreement.
If there is a conflict between these Terms and a signed project agreement, the applicable signed project agreement will control with respect to that specific project, unless otherwise required by law.
